1. Overview

PyChicken LLC provides professional software development, graphic design, and DTP services. Because our Services involve skilled labor and dedicated time, our refund policy is structured to reflect the nature of service-based engagements. Please read this policy carefully before placing an order.

By purchasing our Services, you agree to this Refund Policy, which forms part of our Terms of Service.


2. Hourly Packages

2.1 Purchased but Unused Packages

If you have purchased a prepaid hourly package and no work has commenced, you may request a full refund within 7 calendar days of purchase, provided that PyChicken has not yet begun any work on your project.

To request a refund, contact us at billing@pychicken.com with your order details.

2.2 Partially Used Packages

If work has commenced and hours have been consumed, refunds are available only for the unused portion of the package. The unused hours will be refunded at the rate paid per hour.

Example: You purchased a 10-hour package at $1,500 ($150/hr). If 3 hours of work have been completed and delivered, you are eligible for a refund of $1,050 (7 unused hours × $150).

2.3 Completed Packages

No refunds are issued for fully consumed hourly packages. Once all hours have been worked and deliverables provided, the engagement is considered complete.


3. Fixed-Price Projects

3.1 Pre-Commencement Cancellation

If you cancel a fixed-price project before any work has commenced, any deposit paid is refundable in full, provided cancellation is requested within 7 calendar days of deposit payment.

3.2 Cancellation After Commencement — Milestone-Based Refunds

For fixed-price projects where work has commenced, refunds are calculated based on project milestones:

"Cost of work performed to date" is calculated at PyChicken's standard hourly rate of $150/hr for hours actually worked, regardless of the agreed fixed price.

3.3 Project Disputes — Deliverable Quality

If you believe a deliverable does not materially conform to the agreed specifications in the Statement of Work ("SOW"), you must:

  1. Notify PyChicken in writing within 5 business days of delivery, specifying the deficiencies in detail.
  2. Allow PyChicken a reasonable opportunity to correct the deficiencies (minimum 10 business days).

If PyChicken is unable to deliver a conforming deliverable after two (2) correction attempts, we will issue a partial or full refund at our discretion based on the extent of non-conformance. Subjective dissatisfaction with creative choices that conform to the agreed brief does not constitute a basis for a refund.


4. Retainer Agreements

4.1 Monthly Retainer Fees

Monthly retainer fees paid in advance are non-refundable for the current billing period once the period has commenced.

4.2 Cancellation

Retainers may be cancelled in accordance with the notice period specified in the applicable retainer agreement (typically 30 days). Fees for any notice period served are due and non-refundable.


5. Non-Refundable Items

The following are non-refundable under any circumstances:

  • Hours for work that has been completed and delivered, regardless of Client's decision to use the deliverable.
  • Fees for approved milestones in a fixed-price project.
  • Third-party costs (licenses, stock assets, hosting, domain fees, etc.) procured by PyChicken on the Client's behalf.
  • Rush fees or priority handling fees.
  • Payment processing fees charged by Stripe or PayPal.

6. Refund Process

6.1 How to Request

To request a refund, email billing@pychicken.com with:

  • Your name and order number
  • The reason for the refund request
  • The amount you believe you are owed

We aim to respond to all refund requests within 5 business days.

6.2 Refund Method

Approved refunds are issued via the original payment method:

  • Stripe payments: Refunded to the original card within 5–10 business days.
  • PayPal payments: Refunded to your PayPal account within 3–5 business days.
  • Bank transfer payments: Refunded via wire transfer within 10 business days. The Client is responsible for providing accurate banking details. Any bank fees associated with the transfer are deducted from the refund amount.

6.3 Currency

All refunds are issued in US Dollars (USD). PyChicken is not responsible for exchange rate differences if you paid in a currency other than USD.


7. Chargebacks

We ask that you contact us at billing@pychicken.com before initiating a chargeback with your bank or payment provider. We are committed to resolving disputes fairly and promptly.

Initiating a chargeback for work that has been delivered and conforms to the agreed scope may be considered a breach of our Terms of Service. We reserve the right to provide evidence of work performed to your bank or payment processor in any chargeback dispute.


8. Changes to This Policy

PyChicken reserves the right to update this Refund Policy at any time. Changes take effect upon posting to the Website. Your continued use of Services after the effective date constitutes acceptance of the updated policy.
